The Americans with Disabilities Act (ADA) mandates that businesses provide equal access to public spaces, employment and housing for individuals with disabilities. A critical component of this law is the right of individuals with disabilities to be accompanied by a service dog that performs specific tasks related to their condition.

Despite these legal requirements, some businesses still discriminate against individuals with service dogs. Understanding your obligations under the ADA and how to handle situations involving service dogs is essential to avoid legal repercussions and ensure fair treatment.

Identifying discriminatory practices

Discrimination against those with service dogs can manifest in several ways, often due to misunderstandings or lack of awareness. Common examples of non-compliant behavior include:

  • Denial of Access: Refusing entry to a person accompanied by a service dog in restaurants, stores or on public transportation is a direct violation of the ADA.
  • Excessive Documentation Requests: Requiring more documentation than the ADA mandates, such as proof of disability or detailed medical records, can be considered discriminatory.
  • Hostile Treatment: Harassing or intimidating someone because they have a service dog violates ADA rights and creates a hostile environment that can harm your business reputation.

Steps to ensure compliance and handle potential violations

If your business encounters a situation involving a service dog, taking the following steps can help you comply with the ADA and avoid costly legal issues:

  • Stay Educated and Informed: Ensure all staff members understand that individuals with service dogs are allowed entry under the ADA. Regular training on ADA requirements can help prevent unintentional violations.
  • Respect Privacy and Documentation Standards: Under the ADA, you may ask only two questions: whether the dog is required because of a disability and what task the dog has been trained to perform. Avoid asking for additional documentation or detailed medical information, as this can be discriminatory.
  • Document and Address Incidents Properly: If a service dog’s presence is questioned in an incident, calmly document the situation, including the date, time, location and the individuals involved. This documentation can be crucial if the situation escalates and requires legal resolution.

Taking these proactive steps helps you comply with the law and fosters an inclusive and welcoming environment for all customers, which can enhance your business’s reputation and customer loyalty.
