ADA compliance concerns: Hotels with beach access

On Behalf of Karlin Law Firm LLP | Sep 23, 2024 | ADA |

Hotels with beach access offer a highly desirable experience for guests. But even as running these businesses is a potentially lucrative endeavor, this task also involves navigating specific challenges when it comes to Hotels complying with the Americans with Disabilities Act (ADA), be they Beach Hotels in California, New Jersey, or Florida.   Each Beachfront hotel is unique and the nature and extent of ADA compliance for Beachfront hotels will depend on many different factors which may include, the age of the hotel, as it built before 1991 or remodeled after that date? the number and location of any Beach Hotel ADA rooms, the difficulty in providing access, and many other factors.

Hotel ADA compliance helps to ensure that all guests can fully enjoy the facilities and amenities that a hotel has to offer. For hotels in Orange County, California, where beach tourism is a significant draw, addressing ADA compliance concerns related to beach access is important to avoid legal liability and to provide an inclusive environment for all guests.

Accessible routes to the beach if and when required

One of the primary concerns for ADA compliance in hotels with beach access is providing an accessible route from the hotel property to the beach. This route must be navigable by individuals using wheelchairs, scooters or other mobility devices.

When required, the path should be firm, stable and slip-resistant. Installing beach access mats or pathways that extend onto the sand, creating a smooth and accessible surface for guests with mobility impairments is generally wise. Alternatively, hotels may provide beach wheelchairs, which are designed to navigate sandy terrain, or offer assistance to guests in reaching the beach.

Accessible beach amenities

Once on the beach, if access is required, hotels must ensure that guests with disabilities can access and enjoy beach amenities. This might include providing such amenities (where the amenity is being provided for hotel guests in general) accessible seating options, such as beach loungers that are higher off the ground, and ensuring that beach cabanas, umbrellas and other amenities are reachable via accessible routes.

If the hotel offers water activities for its guests, such as kayaking or paddleboarding, it’s important to provide adaptive equipment and trained staff to assist guests with disabilities.

Accessible rooms with beach views if such rooms are available to other guests

For hotels that promote beach views as part of their luxury experience, it’s important to ensure that accessible rooms offer the same level of access and enjoyment.

This could include providing accessible balconies and window views that can be comfortably reached and enjoyed by guests using mobility devices. If the hotel has beachside dining or event spaces, these areas must also be accessible, with ramps, elevators and accessible seating.

By making these ADA accommodations and amenities, beachfront hotels can better ensure that they aren’t targeted for scrutiny and potentially expensive lawsuits.
