How companies can limit the risk of website-related ADA suits

The Americans with Disabilities Act (ADA) helps protect the rights of people with medical challenges. Individuals with disabling medical conditions have the right to certain accommodations from their employers and landlords. They also have the right to access the same businesses and services as anyone else.

Companies and property owners generally need to ensure that they consider accessibility for everyone, not just able-bodied individuals. ADA compliance requires that business leaders consider people with an assortment of different medical challenges when deciding how to do business.

Accessibility issues do not just relate to physical premises. Websites can play a critical role in how companies operate. In recent years, many ADA lawsuits against businesses have to do with inaccessible and ADA noncompliant websites. How can companies that use the web to conduct business protect against website-related ADA litigation?

By investing in an accessible site

Accessible sites may require special coding. They need to work with screen-reading software and other systems intended to help those with visual impairments navigate the internet. Having text that describes images is important. So are captions for videos. Even details related to website colors and fonts can impact accessibility.

Of course, building an accessible website from the ground up can be incredibly costly, as is re-working an existing site to make it accessible. Failing to make a website accessible can eventually cost the company far more.

By providing alternative options

Allowing people who come to the business in person or contact employees through telecommunication systems to access the same pricing and special offers as those using the website is one way to prevent claims of ADA violations because certain people cannot easily navigate the business’s website.

Companies may need help ensuring that their facilities and digital spaces conform to all ADA requirements. They may need help auditing their premises and website. They may also need insight into the adjustments that are necessary to ensure their compliance with the law.

Securing appropriate assistance when responding to allegations of website-related ADA violations or while planning to create an accessible business model can limit the risk of a costly lawsuit. Website-related ADA violations can cost companies thousands and can also damage their reputations.
